Terms of Service

These Terms of Service govern your access to and use of Practice Monster, the web application at https://practice.monster (the "Service"). By creating an account or using the Service, you agree to these Terms.

The Service

Practice Monster is a practice studio for musicians. It lets you keep a repertoire for each instrument, build jam lists, log sessions, and connect with players you choose to befriend.

We may change, suspend, or discontinue features of the Service at any time, including closing new sign-ups. The Practice Monster name, interface, and software are ours. These Terms do not grant you a license to copy or redistribute the Service.

Eligibility

You must be at least 13 years old to use the Service.

Accounts

You create an account with an email address and password. You are responsible to keep that password safe; we encourage you to use a strong password. If you lose your password, we will email you a reset link upon request. We also send you a required confirmation email when you create your account.

You may delete your account from Settings. We may suspend or delete an account that violates these Terms, that is used to spam, harass, or disrupt the Service, or that we reasonably believe poses a risk to the Service or other users.

Your content

You retain ownership of the data you add ("Your Content"). You grant us a worldwide, non-exclusive license to host, store, reproduce, and display Your Content solely as needed to operate the Service for you and for people you share it with.

You represent that you have the rights needed to add Your Content. Do not upload material you do not have permission to use.

Acceptable use

You agree not to:

  • Access another person's account or data, or attempt to do so
  • Scrape, overload, or interfere with the Service or its infrastructure
  • Harass, threaten, or impersonate other users
  • Create accounts or send messages by automated means, or otherwise spam the Service
  • Upload content you do not have the right to use
  • Upload content that is illegal, harmful, or violates the rights of others

Third-party services

The Service may display content from third parties you choose to link, including YouTube videos. Those services are governed by their own terms. We are not responsible for third-party content or sites. See Privacy for how those services receive information.

Disclaimers and limitation of liability

The Service is provided as is and as available. We make no warranties, express or implied, including that the Service will be uninterrupted or error-free, or that your repertoire, sessions, friends, or other data will never be lost. To the fullest extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We reserve the right to terminate your account or access to the Service for any reason, including violation of these Terms. We are not liable for any loss or damage resulting from such termination.

To the fullest extent permitted by law, our total liability for any claim arising out of these Terms or the Service is limited to the amount you paid us (if any) to use the Service in the twelve months before the claim.

Changes

We may update these Terms from time to time. The revised Terms will be posted on this page with a new last-updated date. Continued use of the Service after that posting constitutes acceptance of the revised Terms.
